PRIVACY POLICY
1. General provisions
These “Terms of Use” (hereinafter referred to as the “Terms”) are a legally binding document which sets out the rights, obligations, and responsibilities between the Buyer (hereinafter referred to as the “Buyer”) and the Seller (hereinafter referred to as the “Seller”) in relation to the Buyer’s purchase of goods from the Seller’s online shop www.zalvariojura.lt (hereinafter referred to as the “e-shop”).
Attention! By accessing the e-shop, you accept all the conditions of these Terms and agree to be bound by them.
2. Concluding the sale and purchase agreement
The sale and purchase agreement between the Buyer and the Seller shall be deemed concluded from the moment the Buyer, after having created a shopping cart in the e-shop, indicated the delivery address, selected the payment method, and read these Terms, clicks on the button “Confirm order”. The agreement shall remain effective until the obligations under the terms of this agreement have been fulfilled. Each agreement concluded between the Buyer and the Seller shall be registered and stored in the Seller’s e-shop database.
3. Rights and obligations of the Buyer
3.1 In accordance with these Terms and the legislation of the Republic of Lithuania, the Buyer shall have the right to purchase goods in the e-shop.
3.2 The Buyer (consumer) shall have the right to withdraw from the sale and purchase agreement of goods with the Seller by notifying the Seller in writing within 7 working days from the date of delivery of the goods, in accordance with Order No 258 of the Minister of Economy of the Republic of Lithuania of 17 August 2001, “On the Approval of the Rules for the Sale of Goods and Provision of Services when Agreements are Concluded by Means of Communication”. The Buyer shall have other rights as provided in the Terms and in the legislation of the Republic of Lithuania.
3.3 If there are any changes to the details provided on the Buyer’s registration form, the Buyer must update them immediately.
3.4 The goods selected by the Buyer shall be reserved, and the Seller shall proceed with the execution of the sale and purchase agreement only when the Seller has received notification of payment for the selected goods from the Buyer’s bank. The Buyer must confirm the payment transfer no later than 3 working days after clicking the “Confirm Order” button. If the payment transfer is not confirmed within this time limit, the Seller has the right to consider that the Buyer has withdrawn from the sale and purchase agreement.
3.5 If the Buyer does not like the shape, size, colour, model, or assembly of the goods, the Buyer shall return the goods (if returnable) by their own means of transport or shall pay the cost of return.
3.7 The Buyer shall comply with other requirements set out in the Terms and in the legislation of the Republic of Lithuania.
4. Rights and obligations of the Seller
4.1 If the Buyer attempts to interfere with the operation or stable functioning of the e-shop, the Seller may, without prior notice, restrict or suspend (terminate) the Buyer’s access to the e-shop.
4.2 The Seller shall have the right to temporarily or indefinitely terminate the operation of the e-shop without prior notice.
4.3 The Seller shall have other rights set out in the Terms and in the legislation of the Republic of Lithuania.
4.4 The Seller shall enable the Buyer to properly use the services provided by the e-shop.
4.5 The Seller shall arrange delivery of the goods ordered by the Buyer to the address specified by the Buyer.
4.6 The Seller, in the event of important circumstances, being unable to deliver the goods ordered to the Buyer, undertakes to offer the Buyer an alternative product, and if the Buyer refuses to accept the alternative product, to refund the money paid by the Buyer within 3 working days if the Buyer has made a pre-payment.
4.7 If the purchased goods do not meet the quality requirements, the Seller undertakes to replace the defective goods with goods of the correct quality, to reduce the price of the goods accordingly, or to refund the money paid for the goods and their delivery, within 7 days of the request.
4.8 In the event of termination of the agreement within 7 days, the Seller undertakes to refund the money for the returned goods in good condition (if returnable) within 7 days.
5. Delivery of goods
5.1 The goods shall be delivered by the Seller or by the methods specified in the “Delivery Methods” section within a specified time limit after receipt of payment for the goods.
5.2 Upon receipt of the delivery, the Buyer, together with the carrier, shall inspect the condition of the delivery. If the delivery has been damaged, the Buyer shall mark this on the delivery note (bill of lading). The acceptance of the goods and the signing of the delivery note (bill of lading) without any remarks shall confirm that the delivery has not been damaged and has been delivered properly.
6. Returning goods
6.1 Returns of goods purchased in the e-shop shall be made in accordance with Order No 258 of the Minister of Economy of the Republic of Lithuania of 17 August 2001, “On the Approval of the Rules for the Sale of Goods and Provision of Services when Agreements are Concluded by Means of Communication” and Order No 217 of the Minister of Economy of the Republic of Lithuania of 29 June 2001, “On the Approval of the Rules for Returns and Exchanges of Items”.
6.2 The Seller shall replace or take back the goods which the Buyer does not like the shape, size, colour, model, or assembly of within 14 days from the date of delivery. The Buyer shall return the unsuitable goods by their own means of transport or pay the return costs, in which case the cost of shipping the goods shall be deducted from the refundable amount of the order.
6.3 Once the Buyer decides to terminate the agreement and notifies the Seller, the Buyer shall lose the right to use the goods from the date of the notice. The date and time of the notice shall be determined by the time the notice has been sent by the Buyer. If it is established that the goods have been consumed (used) after the notice has been sent, the Seller has the right to refuse to terminate the agreement.
6.4 The Buyer may exercise the right of return if the goods have not been used, are in good condition, have not been damaged or lost their marketable appearance, and are returnable. The returned goods must be fully assembled. The Buyer is responsible for the complete assembly and packaging of the goods. If the goods are not completely assembled and properly packed, the Seller or their representative may refuse to accept the returned goods. Changes to the appearance of the goods or their packaging, which were necessary to inspect the goods, shall not be considered a substantial change to the appearance of the goods.
6.5 If the goods purchased did not meet the quality requirements, the Seller undertakes to replace the goods of inadequate quality with goods of suitable quality, to reduce the price of the goods accordingly, or to refund the money paid for the goods and their delivery within 7 days of the request. The goods must be returned in the original packaging of the goods and the parcel.
6.6 Goods that cannot be returned for health and hygiene reasons or that we cannot verify have been opened/used, i.e. opened and used cosmetics/perfumes, any TESTERS (as they are never wrapped in cellophane), will not be accepted back.
7. Responsibility
7.1 The Buyer is responsible for the accuracy of the data provided in the registration form. The Buyer shall be liable for the consequences of any errors or inaccuracies in the data provided in the registration form.
7.2 For the breach of the sale and purchase agreement concluded through the e-shop, the parties shall be liable in accordance with the legislation of the Republic of Lithuania.
7.3 The Buyer shall be liable for the transfer of registration data to third parties. If third parties use the Buyer’s registration data, the Buyer shall be liable for the actions performed by the third party.
7.4 The Seller shall not be liable for the information provided on the websites of other companies, even if the Buyer is directed to these websites via the links provided in the Seller’s e-shop.
7.5 In the event of damage, the guilty party shall reimburse the other party for the incurred losses.
8. Sending information
8.1 The Seller shall send all notifications to the email address provided by the Buyer in the registration form.
8.2 The Buyer shall send all notifications and enquiries to the address specified in the “Contact” section of the Seller’s e-shop.
9. Final provisions
All disagreements arising out of the implementation of these Terms shall be settled by negotiation. In the event of failure to reach an agreement, disputes shall be settled in accordance with the legislation of the Republic of Lithuania.
